1. Acceptance of terms
By downloading, installing, or using the Verdant iOS application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.
These Terms apply to all users of the App. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, solely for personal, non-commercial purposes.
You may not:
- Copy, modify, reverse-engineer, or create derivative works of the App
- Distribute, sublicense, or sell the App or any part of it
- Remove any copyright or proprietary notices
- Use the App in any unlawful manner or for any unlawful purpose
3. Subscriptions & billing
Verdant offers optional auto-renewable subscriptions ("Verdant Pro") that unlock additional features including unlimited plant scans and full library access.
Available plans:
- Weekly subscription
- Monthly subscription
- Yearly subscription (includes a one-week free trial for new subscribers)
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your iTunes/Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Free trial: If offered, the free trial period begins at purchase. Any unused portion of a free trial will be forfeited when you purchase a subscription.
Cancellation: Manage and cancel subscriptions in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period — you retain access until then.
Refunds: All purchases are processed by Apple. Refund requests must be submitted directly to Apple via reportaproblem.apple.com.
Price changes: We may change subscription prices at any time. Existing subscribers will be notified in advance per Apple's guidelines.
4. Informational use only
Plant identification results provided by Verdant are for informational and educational purposes only. They are not a substitute for expert botanical advice.
Do not rely on Verdant to determine whether a plant or any part of it is safe to eat, touch, or use medicinally. Many plants are toxic or harmful. Always consult a qualified expert before consuming or handling any plant based on identification results from any app.
We disclaim all liability for any harm arising from reliance on identification results.
5. Intellectual property
The App, including its design, text, graphics, plant illustrations, and all content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.
6. User conduct
You agree not to use the App to:
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to any system or network
- Interfere with or disrupt the integrity or performance of the App
- Engage in any automated use of the system (scraping, bots, crawlers)
7. Disclaimer of warranties
The App is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy or completeness of plant identification results.
8. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Third-party services
The App uses Apple's App Store for distribution and payment processing. Your use of Apple's services is subject to Apple's terms and privacy policy. We are not responsible for Apple's products or services.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device.
11. Governing law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.
12. Apple-specific terms
The following terms apply with respect to Apple, Inc. ("Apple"):
- These Terms are between you and us only, not with Apple.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the App or your possession or use of the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes to terms
We may revise these Terms at any time by updating this page. The effective date at the top will reflect when the latest version was published. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
